If New York State appropriated funds are being used to request a purchase, and an Invitation to Bid has been issued, New York State Finance Law, 139-k (6), requires that anyone who is contacted by one of the suppliers during the restricted period1 must record such contact2. 1 The "restricted period" is defined as the time commencing on the issuance of the Invitation for Bid to the time the purchase order is submitted to the state for approval.
2 The term "contact" is defined by statute and refers to those oral, written, or electronic communications that a reasonable person would infer are attempts to influence the purchase.
